Justice Minister Advocates Constitutional Protections for LGBTQ+ Community

Germany’s Justice Minister Stefanie Hubig has proposed amending the constitution to explicitly prohibit discrimination based on sexual identity following a recent violent attack on LGBTQ+ individuals in Berlin.

Justice Minister Stefanie Hubig has called for stronger legal protections for the LGBTQ+ community by amending Article 3 of Germany’s constitution. Her push for change follows the deadly attack during Berlin’s Christopher Street Day celebrations in July, which claimed the life of one person and injured dozens. Hubig is advocating for the explicit inclusion of sexual identity as a protected characteristic under anti-discrimination laws.

Article 3 of the German constitution currently prohibits discrimination based on factors such as gender, race, religion, and political beliefs. Hubig argues that it is both logical and necessary to extend these protections to cover sexual orientation, ensuring equal treatment for queer individuals. The proposal has sparked a debate within Germany’s governing coalition, with Hubig seeking support from conservative factions to secure the two-thirds parliamentary majority required for a constitutional amendment.

While securing bipartisan support remains a challenge, Hubig expressed optimism, citing recent statements from Chancellor Friedrich Merz who vowed to prioritize the safety of the LGBTQ+ community following the Berlin attack. Advocates for the amendment, including Germany’s Anti-Discrimination Commissioner Ferda Ataman, view it as a critical step toward fostering inclusivity and safeguarding LGBTQ+ individuals against future violence and prejudice.
